By engaging to rent the 803 Studios, registered as Galaxy Studios LLC, Muscat Oman. CR number: 1469598 Address: Penthouse, Sky Tower, Al-Khuwair, Muscat, Oman (herein after referred to as “The Studio”) you, the undersigned (herein referred to as “The Client”) hereby state that you have read, fully understand, and agree to be bound by the following terms and conditions.
Booking Confirmation
A booking is not considered complete until payment has been made and our booking form has been filled out. At the time of payment, it is deemed that these Terms and Conditions have been agreed upon by the client and payment has been received.
On booking the Studio Premises, The Client accepts that he or she has checked that the studio is deemed to be suitable for the purposes of the hire.
The studio premises and equipment hired by the client are only available for the use of that client.
Length of Use
Rental periods (herein referred to as Rental Period) are pre-arranged at the time of booking. The Client’s Rental Period begins promptly at the designated starting time and ends promptly at the designated ending time. Rental Period time includes set up and break-down. The Studio premises must be cleaned and vacated by the end of the rental period.
No prior drop-off and/or pick-up after completion of shoot, of equipment, props, etc. unless negotiated within (no less than) 48 hours prior to the renal period of The Client which may be subject to additional fees.
Early or extended hours must be worked out and paid for in advance no less than 72 hours prior to the beginning of the rental period.
Punctuality and Overtime
The Studio premises must be vacated on time. Set-up, breakdown, cleanup, pack-up are all included in the reserved time that was scheduled and agreed to. Overtime fees are 20 Omani Rials per hour and are billed in 15 minute increments. (For practical purposes, this means that if you are in the space from 1 to 15 minutes beyond your allotted time, you shall be billed 5 rials in late fees. 16 to 30 minutes over will incur a fee of 10 Rials etc.…)
Cancellation Policy
A confirmed booking is non-refundable. However, the booking can be rescheduled with a minimum of 48 hour notice before the original booking date. The rescheduled date must be within 60 days from the original booking date.
Terms of Use
The Client and related parties must read and take notice of on-site signage, staff instructions, and be kind to all other clients.
The Studio is available for the exclusive use of The Client named in the booking and the Customer is not permitted to sub-contract sub-let or otherwise permit any third party to utilize the Studio.
The Studio is not sound proof therefore we can make no guarantees as the the quality of audio captured in the Studio. By signing this agreement Renter agrees that if there is an audio component to their Project, they have surveyed the Studio and deemed it to provide appropriate conditions for their needs, including or not including audio recordings, video, or other multi-media productions.
Use of The Studio and The Equipment is at The Client’s own risk. The Client hereby waives rights to seek legal redress for mishaps, accidents, and/or loss while on our premises.
The Client agrees to leave the studio premises and adjacent grounds in the same condition as they were when The Client arrived.
The Clients are solely responsible for any legal infractions The Client or members of Renter’s party make during the conduct of the shoot, be they in our studio or elsewhere on the grounds. This includes all other violations or citations, and legal action resulting from the conduct of the shoot, taken at whatever time.
The Client agrees to hold harmless The Studio. Its owner, agents, representatives, and contractors acting on its behalf for any loss, accident, or injury to The Client’s self or anyone who accompanies The Client while on our premises. The Client agrees to be solely responsible for the conduct and welfare of all persons accompanying The Client while on our premises. The Clients are solely responsible for the safety and well-being of any party The Client engages.
The Client understands that if the Company observes dangerous, pornographic, or negligent practices or activities the Company reserves the right to stop the shoot and require Renter and Renter’s party to leave immediately — However, The Studio assumes NO RESPONSIBILITY to act in such cases.
The Client agrees to hold The Studio. Its agents, representatives, and anyone acting on behalf of The Client completely harmless from any action, legal or otherwise, that results from Renter’s conduct.
Equipment
The Studio hire comes with a range of lighting and studio equipment as standard. With extras to be hired out at the request of the booker (herein referred to as The Equipment).
The Studio agrees to provide The Equipment in good working order, but makes no special guarantees as to said Equipment’s functionality or suitability for The Client’s purposes. Any Equipment lost, damaged or stolen will be charged to The Client at its full replacement cost. The Client may not remove any Equipment from The Studio’s premises and all Equipment must be returned promptly at the end of The Rental Period and in the same condition that it was in at the start of the hire period. The Client is fully and solely responsible for any breakages or damage to supplied Equipment.
The Client may not without the written consent of The 803 Studios: (a) remove the equipment from the studio premises; or (b) modify or alter or tamper with the equipment in any way; nor (c) use the equipment in a manner not recommended by the manufacturer; nor (d) allow the equipment to be used by any untrained or unauthorised personnel. Equipment must be returned promptly at the end of the Rental Period in the original condition.
All equipment is rented in good working condition and is to be returned in the same state of good working condition / appearance. Any repair work necessary shall be paid by the customer. If the condition of the equipment is beyond repair, the customer shall pay for full replacement.
Breakages, Losses and Damages
The Client hiring the studio is responsible for all breakages, losses or damages caused to the studio or equipment by him/her, or any other person from his/her team, during the use of the studio. The Studio presumes that The Client, hirers and their crew are competent and capable of using equipment and facilities supplied by the studio. It is the hirer’s responsibility to ensure that all are qualified and capable of the job they are doing. The Client will be held liable for any misuse or damages incurred.
The Studio agrees to provide The Equipment in good working order but makes no special guarantees as to said Equipment’s functionality or suitability for The Client’s purposes. The Client must notify The 803 Studios at the time of supply if the condition of the equipment or studio space is not acceptable. Any of The Equipment lost, damaged or stolen will be charged to The Client at its full replacement cost.
The Client shall be responsible for any loss or damage to or theft of its own equipment or property or that of its guests.
Cleaning
General cleaning is included in the studio hire rate. Studios should be left in the same condition they are found, if the studios are left in a messy condition a minimum 30 OMR cleaning fee applies.
In an effort to keep the Cyclorama “Cyc” walls and floor clean for others who will use the studio, make sure that no one steps on the curved part of the wall and that no one puts their hands on the curve or the surrounding walls. If there is any damages to the cycloroma outside of what would be reasonably expected during a photographic/vide graphic shoot such as skid marks, a repainting fee shall be charged at a rate of 40 OMR or more depending on the damages occurred.
Health and Safety
The Clients are responsible for the health & safety of their shoot. It is the client’s responsibility to conduct their own health and safety and hazard assessment prior to their shoot.
Prior to commencing work, Clients should familiarise themselves with the location of the clearly-marked fire exit in the building. In the event of injury, the Studio provides a First Aid Kit. However, the studio is unable to provide First Aid qualified personnel.
The balcony which is part of The Studio premises can only be used by The Client after obtaining prior approval from management. The Client is solely responsible for all safety aspects and well-being of all and any persons accompanying The Client. The Client agrees that no individual, model, hirer, contractor or any such individual accompanying The Client must not lean on, climb on to and/or lean back on the railing of said balcony. The Client agrees to hold The Studio. Its agents, representatives, and anyone acting on behalf of The Client completely harmless from any action, legal or otherwise, that results from The Client or its representatives’ conduct.
For any emergency situations including accidents, health crises, criminal activities, or fire, call 9999. There is no phone available at the studio. It is advised to have a cell phone close at hand.
Capacity
A maximum capacity of 6 people is permitted during the studio booking in either Studio one or Studio two. Additional persons will be asked to leave
Minors
The Client must ensure that all minors under the age of 18, are always accompanied by a legal guardian, or chaperone. Minors must have a parent’s or guardian’s permission to be at The Studio premises, and/or to be photographed or filmed as relevant.
The Client is solely responsible for verifying that all models employed during Renter’s rental period are of legal age for the activities they are to be engaged in. The Studio has no responsibility to determine or verify the age of participants in The Client’s activities but reserves the right to end those activities if it becomes aware that legal age violations are on-going.
Food and Drink
Food and drink are not to be consumed within the Studio premises and may only be consumed within the designated areas.
Pets & Animals
No pets are allowed within The Studio.
Smoking
Smoking is not permitted anywhere within the studio premises.
Flame, Fire or Pyrotechnics:
Open flame, fire and pyrotechnics are prohibited at all times inside the facility and within the grounds of the studio.
Security
CCTV recording is active in The 803 Studios. Such recordings are captured and processed in the legitimate business interests of:
• The safety and security of our customers
• The safety and security of our staff
• The safety and security of our premises and property
• The protection against, detection of and evidencing of criminal activities
• The reduction of company losses and inventory discrepancies
CCTV footage of customers is recorded by cameras as laid out in our internal CCTV policy and camera layout procedures. The physical technological infrastructure and recordings are stored and backed-up internally.
As a general rule we will not disclose this data to third parties unless required to be provided to legal authorities when we have a statutory obligation to provide such recordings. Recordings may at times be used in evidencing legal/ongoing disputes where all requirements for the access and storage of such data have been met as laid out in our internal investigation procedures.
Storage duration / criteria for specifying the storage duration:
CCTV footage is kept for a period of up to 28 days from the time of recording unless specified separately under licence requirements. As so far as there is a potential/ongoing claim then footage may be retained for a period of up to 3 years or until the claim is finalised. Where there has been access requests successfully provided to recipients then still images shall be securely filed to evidence further correspondence on such footage for a period of 90 days.
Parking
There is free parking directly out the front of the studio and on the side buildings. We only provide 1 parking lot space for offloading equipment upon request.
The Studio will not be held responsible for penalty fines incurred by Studio Clients and their visitors who park their vehicles in contravention of prevailing traffic laws, the Studios Car Park or associated parking facilities.
Any parking provided by the studio is used at one’s own risk – the studio accepts no responsibility for any damage or theft to any vehicle.
Usage of Behind The Scenes Media
The Company has the right to use any and all pictures and behind the scenes media captured within the Studio for use in promotional media including but not limited to: social media ( Instagram, Twitter, TikTok, etc.), printed material and company website. The Company will observe any reasonable request to withhold sharing of such media should it be considered confidential and/or private until a particular date.
Severability
Parties agree that if any provision of this Agreement is held to be unenforceable, then the provision will be modified to the minimum extent necessary to make it enforceable, unless that modification is not permitted by law or would eliminate its intent. If a provision is found to be unenforceable and cannot be modified in a way that preserves the intention of the parties at the point of execution of the agreement, that provision will be disregarded. Parties further agree that if any provision is disregarded or determined to be unenforceable, then this agreement and the remaining provisions of this agreement will remain in effect and enforceable as written.
Headings
Section and other headings contained in these Terms and Conditions are for reference purposes only and are not intended to describe, interpret, define, or limit the scope, extent, or intent of this Agreement or any provision of these Terms and Conditions.
Governing Law
These terms and conditions are governed by the Laws of The Sultanate of Oman. Any disputes arising from this agreement shall be under the jurisdiction of the Courts of Law within the Sultanate of Oman.
